Independent tribunal preferred on school exclusions

Responding to his contribution during Spokesperson Questions to the Counsel General, Mark Isherwood MS, Shadow Counsel General, said:

“I’ve raised concerns before about how vulnerable children and their families in Wales are being let down because the Education Tribunal lacks enforcement powers.

“Even after the High Court ruled in 2018 that excluding an autistic pupil for behaviour related to their autism is unlawful, these cases still occur.

“I’ll be closely watching the Counsel General’s progress in transferring exclusion powers from local authorities and schools to the First Tier Tribunal for Wales following consultation responses that favoured the Tribunal as an independent panel for fair and just school exclusion decisions.”
