NOTICE OF APPLICATION TO MAKE A NON MATERIAL CHANGE TO THE FOLLOWING DEVELOPMENT CONSENT ORDER:
THE HIRWAUN GENERATING STATION ORDER 2015(S.I No. 1574) AS CORRECTED BY THE HIRWAUN GENERATING STATION (CORRECTION) ORDER 2015 (S.I No. 2070) AND AMENDED BY THE HIRWAUN GENERATING STATION (AMENDMENT) ORDER 2016 (S.I No. 1087)
Notice is hereby given that an application has been made by Hirwaun Power Limited (“HPL”) of Drax Power Station, Drax, Selby, United Kingdom, YO8 8PH to the Secretary of State for Business, Energy and Industrial Strategy to make a non-material change to the Hirwaun Generating Station Order 2015 (as corrected by the Hirwaun Generating Station (Correction) Order 2015 and amended by the Hirwaun Generating Station (Amendment) Order 2015) (“the Order”) under the Planning Act 2008 (“the Application”).
The Order grants development consent for the construction, operation and maintenance of a generating station with a gross ratedelectrical output of up to 299 MWe comprising up to five gas turbine generators, up to five exhaust gas emission flue stacks and other development that is part of the generating station.
The Application seeks to make non material amendments to the Order to enable the correct sequencing of construction works authorised by the Order and the provision of up to date environmental information. Part of numbered work 2E(g) of the Order, the bat mitigation structure, should be constructed before all other parts of numbered work 2 and before numbered work 1. Alternatively, updated surveys conducted since the Environmental Statement was prepared and submitted in 2012 may demonstrate that suitable bat mitigation could be included within a retained building on the site of the authorised development, with construction of a new bat mitigation structure not required.
Accordingly, non-material amendments need to be made to the structure of the Requirements contained in Schedule 2 to the Order to enable the correct sequencing of the construction works, and to allow the bat mitigation to be tailored according to the most up to date survey data on the bat population present and likely to be affected by works on the site.
